Mississippi High Court Backs Michigan Consumer Judgment

LANSING, Mich. — Mississippi highest court has green-lit Michigan Attorney General Dana Nessel efforts to collect on a consumer-protection award against an out-of-state online furniture seller that took money and left orders unfilled.

Nessel office said Thursday the ruling affirms Mississippi trial judges who already allowed the Michigan judgment to be enrolled where the company sits. If the defendants still refuse to pay, Michigan can seek liens on property, wage garnishment and other collection steps through that local court.

The Attorney General sued in January 2024 under the Michigan Consumer Protection Act, accusing AF LLC, doing business as ACF Wholesale, of pocketing furniture payments, inventing delay stories and often skipping refunds. Ingham County 30th Circuit Court entered an April 2025 award for damages, costs and fees that topped $100,000. A later court summary pegs the default figure at $124,998.68.

The sellers skipped the Michigan case on purpose, planning to fight only when collection reached Mississippi. Justices there said Michigan still had personal jurisdiction because the firm knowingly filled more than a thousand Michigan deliveries, took payments from buyers here, and kept selling into the state. A website clause choosing Mississippi law did not erase those contacts or bind the Attorney General in a statutory case.

Drop-shipping is lawful when a middleman simply routes orders to a manufacturer, the Attorney General stressed. The alleged wrongdoing was collecting cash and then failing to deliver or refund. Nessel consumer team says it has similar cases moving in Ohio and New York and has earlier warned shoppers about drop-ship risks.
